This Acceptable Use Policy (“AUP”) sets forth rules that apply to the use of any of BuildQ Inc.’s (“BuildQ”) services (the “Services”) by you (collectively, “you”). BuildQ is proud of the trust our customers place in us. In exchange, we trust you to use the Services responsibly.
Your use of the Services must comply with this AUP. This AUP is not exhaustive, and BuildQ reserves the right to take remedial action in connection with content or uses not specifically described below. BuildQ may modify this AUP at any time by posting a revised version on BuildQ’s website. Capitalized terms not defined in this AUP have the meanings given in the BuildQ Services Agreement, Service-Specific Terms, or such other written agreement, contract, instrument, or other writing entered into by you and BuildQ governing the provision of the Services to you (the “Agreement”).
You agree not to misuse the Services or help anyone else to do so. You agree that you will not and will not attempt to:
- Probe, scan, or test the vulnerability of any system or network used to provide the Services;
- Represent or hold out Outputs as solely human-generated;
- Use the Services to build a similar or competitive products or feature;
- Breach or otherwise circumvent any security or authentication measures of the Services;
- Access, tamper with, or use non-public areas or parts of the Services, or shared areas of the Services you haven't been invited to;
- Interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services;
- Access, search, or create accounts for the Services by any means other than our publicly supported interfaces (for example, "scraping" or creating accounts in bulk);
- Send unsolicited communications, promotions or advertisements, or spam to other users;
- Send altered, deceptive or false source-identifying information, including "spoofing" or "phishing" to BuildQ or other users;
- Promote or advertise products or services on the Services other than your own without appropriate authorization;
- Use the Services in violation of the Agreement;
- Sell the Services unless specifically authorized by BuildQ to do so;
- Use the Services to back up, or as infrastructure for, your own cloud services;
- Engage in any type of payment fraud, including unauthorized use of credit cards or other payment methods, illegitimate chargebacks, or any other method of obtaining the Services without required payment;
- Publish or share materials in connection with the Services that constitute child sexually exploitative material (including material which may not be illegal child sexual abuse material but which nonetheless sexually exploits or promotes the sexual exploitation of minors), unlawful pornography, or are otherwise indecent;
- Publish or share content in connection with the Services that contains or promotes extreme acts of violence or terrorist activity, including terror or violent extremist propaganda;
- Advocate bigotry, hatred, or the incitement of violence against any person or group of people based on their race, religion, ethnicity, national origin, sex, gender identity, sexual orientation, disability, impairment, or any other characteristic(s) associated with systemic discrimination or marginalization in connection with the Services;
- Harass or abuse other users of the Service or BuildQ personnel or representatives or agents performing services on behalf of BuildQ;
- Violate the privacy or infringe the rights of others, including publishing, sharing, or storing other people’s confidential information, identifying information, or intimate imagery without authorization for the purposes of harassing, exposing, harming, or exploiting them;
- Otherwise violate the law in any way, including publishing or sharing content which depicts, promotes, or instructs on illegal activity, is fraudulent, defamatory, misleading, or exploitative, or that infringes the intellectual property rights of others; or
- Permit or encourage others to commit any of the actions above.
BuildQ endeavors to enforce our policies fairly and consistently. We may monitor compliance with this AUP and investigate any violations. We reserve the right to take swift and appropriate action in response to violations of this AUP, which could include removing or disabling access to content, suspending a user’s access to the Services, including any Workspaces, or terminating or suspending your account and, if appliable, the accounts of your users. We may report any activity that we suspect violates any law or regulation to law enforcement officials, regulators, or other appropriate third parties, and cooperate with them to investigate and prosecute illegal conduct.
